Microsoft sued for Forcing Windows 10 on People and Compared to Skynet

Were You Forced to Upgrade to Windows 10?

Last week three men from Florida started legal suits against Microsoft for forcing Windows 10 upon them. They claim that they were coerced into upgrading to Windows 10 and M$ did not provide any option for them to reject the upgrade and say their marketing campaign breaches several federal laws in its aggressive tactics.

Many people have installed Windows 10 "by accident" or have woke up the next day to find their OS looking a bit different after simply not being able to avoid all the constant notices encouraging people to download the Free Windows 10 Operating System which is more than capable of installing itself, by itself before your next reboot. Very much like when Skynet becomes officially aware and is able to act autonomously on its own.

The three men suing M$ are Robert Stahl, Ahmad Al Khafaji & Ahmad Abdulreda and it's claimed that M$ will be defending the claim after someone from the M$ HQ said;

The Windows 10 upgrade is a choice designed to help people take advantage of the most secure, and most productive Windows. Customers have the option not to upgrade to Windows 10. Should a customer need help with the upgrade experience, we have numerous options including free customer support. We believe the plaintiffs’ claims are without merit and we are confident we’ll be successful in court.

They do say that anyone that upgrades to Windows 10 can downgrade back to their previous OS again within one month of installing Windows 10 but this isn't made very clear to the user.

And there's still the elephant in the room! There's still the aggressive marketing techniques used which for such a big company begs question. Just recently, M$ changed the way that people are notified and prompted into upgrading to Windows 10 following complaints from people claiming the upgrade took place on its own without their permission to do so.

Also I don't remember if you remember the notification but clicking the little red x in the top right hand corner of the upgrade window to just close the window wouldn't stop the update from being scheduled anyway.

Will they win? Well according to the Tech Times, M$ have already previously been sued and lost in another recent court case just last month where M$ paid a Teri Goldstein from California $10,000 dollars recovery for lost earnings she incurred and a new computer which she claims was damaged after the unauthorized upgrade to Windows 10 which didn't work but failed and crashed her computer so that it wouldn't work for days making her travel agency business grind to a halt in what would ordinarily be a busy time of the year.

The actual lawsuit itself was ended after plaintiffs ruled M$ broke more than three different acts one being the Controlling the Assault of Non-Solicited Pornography and Marketing Act, the Junk Fax Prevention Act and the Clayton Antitrust Act and others.

An argument put across was is that some computers are not powerful enough to run Windows 10 OS on them which is more memory intensive than previous Windows OS's and that even after the upgrade has happened, one would need to be very computer literally and savvy to then remove it and downgrade. In fact they even suggested that all the forced upgrades could run into tens of millions of dollars of damage to peoples computers and maybe ten times that much in lawsuits being filed against M$ if those same people come forward and open further lawsuits.

A Necessary Evil?

The judging plaintiffs make a point when they say that M$ was well aware of all the damage that would be done to peoples computers by forcing the upgrade on them but still went ahead and done that, quite aggressively too coming to the assumption that it would only be a small amount of users that would have a problem. However that same small percentage of people could be a very costly and seriously damaging thing to one of the worlds giant super organizations that is M$. And they obviously have their reasons for using such aggressive marketing techniques. Especially when you consider the fact that Windows 10 was FREE! It must be that there is a logical reason for this and it makes more sense for them for the majority of computers in the world to be running Windows 10 instead of any other OS.

M$ do say that Windows 10 is the most stable and most secure OS of them all. And so that from that perspective, it's the one that has the less viruses/malware etc targeted to it. So that would make sense because they don't want people to get infected and fall a victim to that as those same people will blame M$ for it so one can understand that and they have that going for them.

There's clearly much more motive to it than meets the eye. But this could cause other people to follow suit and further sue M$ for even more damages and losses.

A couple of weeks ago, early in the wee hours of the morning somewhere around 1:30 am I started my day as usual. I got up switched on a few computers and made some coffee. Returning into the office cup in hand and to my surprise I noticed that one of the computers was in the process of installing Windows 10. Totally freaking out and yelling STOP in my head I rushed over to the terminal and did a Ctrl Alt Delete, then nothing! Realization quickly sunk in that I had to act and act fast or risk losing everything that I rely on that is not compatible with windows 10. Panic was setting in when I made the executive decision to just do a hard shut down holding the power button. After re-booting I noticed a lot of errors even a popup that states that this copy of windows in not genuine. Really? because I purchased the computer from Dell Business and have the disk. Hmmm, I guess that Dell has decided to start bootlegging copies of Windows OS, LOL. Microsoft sued for Forcing Windows 10 on People and Compared to Skynet To make a long story short I now need a windows system administrator to try and fix everything including saving all the programs, all the data, and we may even have to wipe the disk, do a fresh install, get all the updates and more, Uggh! Unfortunately for me my guy costs me 110$ per hour with a 5 hour minimum, I know expensive but "you get what you pay for". This is going to hurt my pocket big time if we need to wipe the disk, reinstall and do everything else! Thank you Microsoft that nice little gift!

Actually at some point there is no way to stop the upgrade, or to even cancel them. The upgrade to Windows 10 will happen automatically, especially if you post the update for some time in the future. They may have fixed this now, im unsure, but there were many complaints of Windows users having to upgrade when they never initiated the upgrade in the fist place.

I despise Window 10, not only do I NOT like the design of it, I also hate how they track everything you do via Cortana, and use other intrusive tracking. They of course then sell this data to advertising companies. I have a Windows 7 desktop that can't run Windows 10 becaue my CPU isn't supported, and it's not supported becuase i don't want it to be, otherwise it will upgrade to Windows 10. EW!

I wasn't forced into upgrading. I was running Windows 8 (not 8.1), which doesn't qualify for the free Windows 10 upgrade. Instead I had to install the 8.1 update (which crashed my computer every time sometimes damaging the OS. I ended up installing it manually), then upgraded to Windows 10 (which also crashed my computer sometimes damaging the OS, though I did eventually get it to install). After the upgrade was activated I did a clean install to avoid any quirks, and I've been running Windows 10 since last summer. I like it better than 8/8.1 (despite it being more buggy), but not as much as Windows 7, Vista, or XP.

I think my favorite Operating System of all time would be Windows XP. It is lighter than other bulky newer versions of Windows, however it is discontinued. I have a laptop that has Windows XP on it, and I'm still wondering if I should at least upgrade to Windows Vista, or Windows 7.

I am totally find with Windows 7, the operating system for Windows 8 through Windows 10 seems to have more code, which will kill the HD capacity, or at least mine since it only holds like 80 GB of data. However, Windows XP doesn't even come close, and only uses about 10 GB I believe, and Windows XP doesn't use as much resources as the newer windows versions. I'm also assuming Microsoft believes everyone is running top of the line computers.. ..

I also have an old XP laptop (40GiB) that I use on occasion (mostly to watch DVDs). I can't viably upgrade it to newer versions of Windows, because the integrated graphics are too old, and for my usage on it XP is presently a better fit than GNU/Linux.

I still use windows 7, have tried windows 10 at work, I find it good enough, but I'll stick with Windows 7 for a couple more years. Maybe I'll update when my current laptop will die and I'll have to buy a new one.
Also, I keep all the windows updates turned off, got no notifications to update, hope it will remain that way in the future.

That was really interesting, I really admire these guys for having the courage to stand up to such a huge company. Your post got me thinking that it is indeed rather funny that it was provided for free, and that is what I thought when I started to get all those messages to install it. The aggressive marketing was also quite strange, I mean what are they gaining from all this constant pushing considering that it is for free? I basically I kept getting the messages to upgrade all the time. Finally they got so annoying that i decided I will just update as I had had enough. I was not impressed by it at first but now I got used to it. Will be interesting to see how it turns out. Let us know what happens!

Oh wow!

I found that little notification coming up very annoying and I was completely confused because I had Windows 10 so I didn't understand why they were asking me to upgrade to Windows 10. Even though I kept saying no they notification would just pop up again soon.

My hard drive went recently and I had to have it replaced and the computer repair guys asked me if they could upgrade me to Windows 10. I once again thought oh how odd, I have Windows 10.

I got my laptop back and I have Windows 10 Pro and it is completely different. I am not used to it and I am finding it hard to find everything I need. Oh well.... since the computer repair shop asked my permission and I gave it I don't have a leg to stand on. Plus I don't think I qualify for loss if income.

Lucky me I'm on iOS ,but none the less I was interested in what you had to say and I think 10,000 is a pretty good number to cover damages and losses forcing upgrades shouldn't be a thing in my opinion due to things like this happening to many times company's force upgrades I deal with it on my iPhone my xbox one everything up grades automatically and there are times that that automated stuff can sneak up creep and bite you in the rear so to speak I guess this was just one of those cases this was a good read

My official computer is running on Windows 7 and I don’t remember being forced to upgrade to Windows 10. Actually, we bought a laptop last year with the understanding that it will run on Windows 10 but the vendor had downgraded the operating system to Windows 7 for reasons of issues in Windows 10. That means if my old laptop will be forced to run on Windows 10, it will probably encounter problems that will impede my working pace.
